Welcome to Qout Spot! These Terms of Service ("Terms") govern your use of the Qout Spot mobile application and website (collectively, the "Platform"), operated by Qout Spot ("we," "us," or "our"). By accessing or using our Platform, you agree to be bound by these Terms and our Privacy Policy.

These Terms are governed by the laws and regulations of the Kingdom of Saudi Arabia.

1. The Qout Spot Platform

Qout Spot is a technology platform that connects users ("Users") with independent food truck operators ("Vendors"). We provide a marketplace for Users to discover, locate, and interact with Vendors.

IMPORTANT: Qout Spot is a Neutral Venue

You acknowledge and agree that Qout Spot is a neutral intermediary platform. We are not a food provider, restaurant, or food truck operator. We do not own, operate, or control any of the Vendors on our Platform. We do not prepare, inspect, or guarantee the quality, safety, or legality of any food or services offered by Vendors.

2. Your Responsibilities

Age Requirement: You must be at least 13 years old to use the Platform. If you are between the ages of 13 and 18, you may only use the Platform with the consent and supervision of a parent or legal guardian.
Accurate Information: You agree to provide accurate and complete information when creating your account.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Disclaimers and Limitation of Liability

This is the most important section for your protection.

3.1. No Responsibility for Vendors

We are not responsible for the actions, omissions, or services of any Vendor. This includes, but is not limited to:

Food Quality & Safety: We do not guarantee the quality, safety, ingredients, or allergen information of any food provided by Vendors. All food is prepared and sold by the Vendors, and they are solely responsible for its safety and compliance with all applicable laws.
Vendor Information: We do not guarantee the accuracy of information provided by Vendors, including menus, prices, operating hours, or location.
Compliance: We do not guarantee that Vendors are in compliance with all applicable laws, regulations, licenses, and permits (e.g., health codes, business licenses).

3.2. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

3.3. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY SAUDI ARABIAN LAW, QOUT SPOT AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

(A) YOUR USE OF THE PLATFORM; (B) YOUR INTERACTIONS WITH ANY VENDORS, INCLUDING ANY FOOD-BORNE ILLNESS, INJURY, OR OTHER DAMAGES; (C) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM; (D) ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

3.4. Your Sole Remedy

YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISPUTE WITH US OR ANY VENDOR IS TO DISCONTINUE YOUR USE OF THE PLATFORM.

4. Content and Intellectual Property

Our Content: All content on the Platform, including text, graphics, logos, and software, is the property of Qout Spot and is protected by copyright and other intellectual property laws.
User Content: You grant us a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, modify, and publish any content you submit to the Platform (e.g., reviews, ratings).
Reviews: All reviews must be truthful and based on your own experience. We reserve the right to remove any reviews that are defamatory, offensive, or violate our policies.

5. Prohibited Conduct

You agree not to:

Use the Platform for any illegal purpose or in violation of any local, national, or international law.
Harass, threaten, or defraud other users or Vendors.
Interfere with the operation of the Platform or any user’s enjoyment of it.
Attempt to circumvent any security measures.

6. Termination

We may terminate or suspend your access to the Platform at any time, without prior notice or liability, for any reason, including if you breach these Terms.

7. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Riyadh, Saudi Arabia.

8. Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will notify you by email or through the Platform. Your continued use of the Platform after any modification constitutes your acceptance of the new Terms.
